    Privacy Policy

    Welcome to CareCircle ("we," "us," or "our"). We are committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your and your care recipient's information when you use our application (the "Service"). Please read this privacy policy carefully. If you do not agree with the terms of this privacy policy, please do not access the application.
    2. Information We Collect
    We may collect information about you in a variety of ways. The information we may collect via the Service includes:
    Information You Provide to Us
    • Account Information: When you register, we collect your name, email address, password, and your relationship to the care recipient.
    • Care Recipient Information: We collect the name and gender of the person receiving care.
    • Care Data: You and other members of your circle provide information related to care, which may include:
    • Care Log entries (notes, mood).
    • Medication details (name, dosage, schedules).
    • Appointments and tasks.
    • Vitals readings (e.g., blood pressure, blood sugar).
    • Chat messages exchanged within your circle.
    Information Processed by Artificial Intelligence
    To provide our AI-powered features (part of our FullCircle premium plan), we process certain data using third-party services, specifically Google's Gemini models. This includes:
    • Care Logs for Appointment Prep: When you use the "AI Prep" feature, recent care log entries are sent to generate a summary and questions.
    • Pill Information: When using the "AI Pill Identification" feature, the text description (imprint, shape, color) or a camera image of a pill is sent for analysis.
    • Circle Assistant Data: When you interact with the Circle Assistant, your questions and a broad context of your circle's recent data (logs, appointments, medications, etc.) are sent to generate a response.
    3. How We Use Your Information
    We use the information we collect to operate, maintain, and provide you with the features and functionality of the Service. This includes:
    • Creating and managing your account and care circle.
    • Displaying care data to you and the members of your circle.
    • Enabling communication between members of your circle.
    • Sending you notifications and reminders related to care tasks and events.
    • Providing, analyzing, and improving our AI-powered features.
    • Monitoring usage to improve the user experience of the Service.
    4. How We Share Your Information
    Your information is shared in the following ways:
    • With Your Care Circle: The primary purpose of CareCircle is collaboration. Therefore, most of the care data you enter is shared with all other active members of your designated care circle.
    • With Service Providers: We share information with third-party vendors who perform services for us. Our primary AI service provider is Google. We only share the information necessary for them to perform their designated function (e.g., analyzing logs for a summary) and require them to protect this information.
    • For Legal Reasons: We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to comply with a legal obligation.
    5. Data Security
    We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse.
    6. Children's Privacy
    Our Service is not intended for individuals under the age of 18. We do not knowingly collect personally identifiable information from children under 18. If we become aware that we have collected personal information from a child under 18 without verification of parental consent, we will take steps to remove that information from our servers.
    7. Your Rights and Choices
    Depending on your location, you may have certain rights regarding your personal information. We provide you with the following abilities to manage your data:
    • Access and Portability: You have the right to request a copy of the personal information we hold about you. You can export a summary of your Care Logs through the application. For a complete data export, please contact our support team.
    • Correction: You have the right to correct any inaccurate information. You can update your personal profile information directly within the 'Settings' section of the app. For corrections to other data, please contact us.
    • Deletion (Right to be Forgotten): You have the right to request the deletion of your account and all associated data. As a circle admin, you can remove other members from your circle. To request the complete deletion of your own account or the entire care circle, please contact us at our support email. Please note that deleting your account is a permanent action and cannot be undone.
    8. Data Retention
    We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). Essentially, we retain your data for as long as your account is active to provide you with the Service.
    When you request to delete your account, we will anonymize your historical contributions (such as care logs and chat messages) and permanently delete your personal information (name, email, etc.) from our active systems within 30 days. Please note that we may retain some information in our backup archives for a longer period for disaster recovery purposes, after which it will be securely deleted. We may also retain anonymized, non-personal information for analytical and statistical purposes.

    Terms of Service

    By accessing and using the CareCircle application ("Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service.
    2. Medical Disclaimer
    THE SERVICE IS FOR INFORMATIONAL AND ORGANIZATIONAL PURPOSES ONLY AND DOES NOT PROVIDE MEDICAL ADVICE. CareCircle is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of information you have obtained through the Service.
    3. The Service
    CareCircle is a collaborative application designed to help families and caregivers manage the health and well-being of a loved one. The Service is provided "as is" and we assume no responsibility for the accuracy, timeliness, or completeness of any user-provided information.
    You are solely responsible for the accuracy and legality of all data and content you input into the Service.
    4. User Age Requirement
    You must be at least 18 years old to create an account and use the Service. By creating an account, you represent and warrant that you meet this age requirement.
    5. AI-Powered Features
    Our FullCircle premium plan includes features that use artificial intelligence ("AI Features"), such as Appointment Prep and Pill Identification, powered by Google's Gemini models. You acknowledge and agree that:
    • AI-generated output may contain inaccuracies or errors. It is not guaranteed to be correct, complete, or up-to-date.
    • You must independently review and verify all AI-generated output. Do not rely on AI Features as a sole source of information, especially for medical or health-related decisions.
    • We are not liable for any errors, omissions, or damages arising from your use of or reliance on the AI Features.
    6. Subscriptions and Payments
    The Service may be available under a free plan or paid subscription plans ("FullCircle").
    • Free Plan: The free plan has limitations, including a limit on the number of members per circle.
    • Paid Subscriptions: By selecting a paid subscription, you agree to pay the specified fees, which will be billed in advance on a recurring and periodic basis (monthly or annually). Subscriptions automatically renew unless canceled.
    • Cancellation: You may cancel your subscription at any time through the Settings page. The cancellation will take effect at the end of the current billing period.
    7. User Conduct
    You agree not to use the Service to upload, post, or transmit any content that is unlawful, harmful, or infringes on the rights of others. You are responsible for maintaining the confidentiality of your account password and PIN and are responsible for all activities that occur under your account.
    8. Intellectual Property Rights
    The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of The CareCircle App, LLC and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. You retain all ownership rights to the health data, notes, images, and other content you upload to the Service.
    9. Privacy Policy
    Your use of the Service is also governed by our Privacy Policy. By agreeing to these Terms, you acknowledge that you have read and understood our Privacy Policy. Our Privacy Policy describes how we collect, use, and share your information.
    10. Termination
    We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason, including but not limited to a breach of these Terms.
    11. Limitation of Liability
    In no event shall CareCircle, nor its directors, employees, partners, or agents, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
    12. Governing Law
    These Terms shall be governed and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law provisions.
    13. Changes to Terms
    We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, either through an in-app notification or by email. What constitutes a material change will be determined at our sole discretion.
